There are a few decent judges left.

Judge Ralph J. Porzio of the New York Supreme Court, who heard the case against the NYC Department of Health and Mental Hygiene, may not have heard President Trump when he declared this a few months ago, but yes, indeed, Judge Porzio sees DJT's point clearly:

Donald Trump: Abolish Mandates & Rehire Every Military Patriot with an Apology & Back Pay

Key elements of the ruling

Judge Ralph J. Porzio wrote in his ruling that:

  • If the jab mandate was about "safety and public health, un-jabbed workers would have been placed on leave the moment the order was issued."
  • "If it was about safety and public health, the Health Commissioner would have issued city-wide mandates for jabs for all residents."
  • "In a City with a nearly 80% jab rate, we shouldn't be penalizing the people who showed up to work, at great risk to themselves and their families, while we were locked down."
  • The judge ruled the "petitioners should not have been terminated" and that "If it was about public safety and health, no one would be exempt."

(Approximately 1,700 employees were fired for being un-jabbed, most being police and firefighters. Yet the NYC mayor's office exempted athletes and performers from the covidiocy jab mandate.)

  • The ruling states that the Oct. 20, 2021, and Dec. 13, 2021, declarations from the Commissioner of Health and Mental Hygiene ordering that all employees get vaccinated are "arbitrary and capricious," ordering that the petitioners be reinstated to their full employment status, and entitled to back pay in salary from date of termination.

Not to be denied their hypocritical proclamationsNew York City appeals the judge's ruling that could reinstate fired unvaccinated employees.

A spokesman with the NYC law department released the following statement:

'The city strongly disagrees with this ruling as the mandate is firmly grounded in law and is critical to New Yorkers' public health. We have already filed an appeal. In the meantime, the mandate remains as this ruling pertains solely to the individual petitioners in this case. We continue to review the court's decision, which conflicts with numerous other rulings already upholding the mandate.'

They even got SlowJoe to mumble a couple of words about the ruling while being publicly fake-jabbed:

'President Joe Biden was asked about the ruling while getting his COVID shot and called it a "local judgment." His own vaccine mandates focused on the federal workforce and employees at large companies.'

And to ensure the fired police officers, firefighters, and other city workers understand just how expendable they are...

'Mayor Eric Adams has announced plans to cut the jab mandate for private companies; his administration has no intention of relaxing the existing mandate for city workers. "The NYC Board of Health voted unanimously Tuesday, Oct 25, 2022, to repeal the jab mandate for private employees'

You can't make this stuff up!
